They have even been mentioned in the Qur'an in general and explained by Imam Hassan Askari in specific, and clearly the gap between general and specific is wide. Hence, this question is raised here that how the delay stating of the time of demand has not been questioned? This piece of writing is to examine the purports of the rule "foulness of the delay of the demand time" first and foremost. Then, the Osuli's (Principles of Jurisprudence Scholar) pronouncements, who have responded to this question, are discussed. Finally, it is stated that as the evidences for the rule of "foulness of the delay of demand time" are scant and due to the critical conditions of the Shiite, the discrete general and specific is not indecent. Nonetheless, given a person intends to commit to the provisions of this rule apparently, he has to distinguish the acts of devotion from the interactions and deals, as the religious devotions based on causation in clues since the reward and punishment is by Allah. This can be mentioned that due to the different rational and transmitted reasons, Allah will suffice the foregone expediency. As for interactions and deals, it should be noted that the events taken place in the canonization era impeded the complete delivering of all religious percepts in the era of the Prophet. In the succeeding eras, such obstacles remained in some other ways and established discretions which removed foulness of the delay of the demand time, as such foulness is non-inherent. Keywords:}, keywords = {Discrete general and specific,the rule of stating delay,ritual decrees,Expediency,transactional decrees}, title_fa = {تأخیر بیان از وقت حاجت در عام و خاصّ منفصل قرآنی و روایی}, abstract_fa = {با توجه به اینکه اکثر احکام شرعی در اسلام به صورتِ عام و خاص منفصل بیان شده است و حتی گاهی عام در قرآن مطرح شده است و خاص توسط امام عسکری (علیه السلام) بیان شده است و میان عام و خاص، صد و اندی سال فاصله است! چگونه «تأخیر بیان از وقت حاجت» پیش نیامده است؟ در این نوشتار ابتدا به به بررسی مفاد قاعدة «قبح تأخیر بیان از وقت حاجت» پرداخته‌ایم. سپس به اقوال اصولیان در مقامِ پاسخ‌گویی به اشکال مزبور، اشاره می‌کنیم. در پایان با توجه به ناتمام بودنِ مستندِ قاعدة «قبح تأخیر بیان از وقت حاجت» و شرایط خاص شیعیان، عام و خاص منفصل هیچ قبحی نخواهد داشت. اما در صورتی که شخصی بخواهد به ظاهر مفاد این قاعده ملتزم گردد، ناگزیر است عرصة عبادات و معاملات را از هم جدا کند؛ در عبادات مطابق مبنایِ سببیت در امارات، چون کیفر و پاداش به دست خداوند است، می‌توان ادعا کرد با توجه به مفاد ادلة عقلی و نقلیِ مختلف، خداوند متعال مصلحتِ فوت شده، را تدارک می‌کند؛ اما در مورد معاملات، باید گفت: رخدادهایی که در عصر تشریع و ابلاغ بروز کرده است، مانعِ ابلاغ کامل همة احکام شرعی در عصر پیامبر (ص) شده است. در اعصار بعد نیز همین موانع به شکل‌های دیگری بروز کرده است ومصالحی را به وجود آورده است که آن مصالح، قبحِ تأخیر بیان از وقت حاجت، که قبحش ذاتی نیست، را برطرف می‌سازد.}, keywords_fa = {عام و خاص منفصل,قاعدة تأخیر بیان,مصلحت,احکام عبادی,احکام معاملی}, url = {http://jostar-fiqh.maalem.ir/article_22676.html}, eprint = {http://jostar-fiqh.maalem.ir/article_22676_eda94a97bd6585ea342f14a4159e4f01.pdf} }
