They believe that a needy judge should earning his livelihood from public treasury.On the other hand, some other group of jurists believe that the presented evidences by the renowned majority of jurists is not competent to prove the prohibition opinion.Both views and their evidences have been examined in this study.  While rejecting the view of the renowned majority of jurists, the view of permission which is more compatible with the rules and principles that dominate the Islamic judicial jurisprudence has been preferred in this article. It has been also proven that when the judge’s remuneration can be paid by parties to a lawsuit there is no reason to impose such a heavy burdenon the public treasury.}, keywords = {Judgment,Bribe,Remuneration,Earning Livelihood of Judge,the Public Treasury}, title_fa = {اخذ اجرت از طرفین دعوا برای قضاوت}, abstract_fa = {یکی از مسائل بحث‌برانگیز و مورد ابتلا در امر قضا، جواز یا عدم جواز دریافت مستقیم هزینه‌های دادرسی از جمله اجرت و مزد قاضی از طرفین دعوی است. مشهور فقهای امامیه اخذ اجرت از طرفین دعوی را جایز ندانسته و معتقدند امرار معاش قاضی غیرمتمکّن باید از طریق بیت‌المال صورت پذیرد. درمقابل، گروه دیگری از فقها معتقدند که ادلۀ بیان‌شده از سوی مشهور فقها، صلاحیت اثبات نظریۀ حرمت را ندارد. در این پژوهش، هردو دیدگاه و ادلۀ آن‌ها بررسی شده‌است و ضمن ردّ دیدگاه مشهور، نظریۀ جواز که با اصول و قواعد حاکم بر فقه قضایی اسلام سازگارتر است، تقویت و ترجیح داده شده‌است و نیز ثابت گردیده است تا زمانی که می‌توان اجرت قاضی را از طرفین دعوی ستاند، دلیلی بر تحمیل چنین بار سنگینی بر دوش بیت‌المال وجود ندارد.}, keywords_fa = {قضا,رشوه,اجرت,ارتزاق قاضی,بیت المال}, url = {http://jostar-fiqh.maalem.ir/article_70125.html}, eprint = {http://jostar-fiqh.maalem.ir/article_70125_2650211632791d0d5ec1e6234b5a287e.pdf} }
