Before Mughal attack, all Imāmiyeh Shiite jurisprudents agreed upon the negation of legitimacy for any other government except the Infallible Imams’ government and any limited cooperation with such governments were merely allowed in case of obligation. Thus, this principle was not violated and this change of attitude lead to the mastery of theological viewpoints on the Imāmiyeh Shiite jurisprudents views. However, in the area of non-Muslim Mughal mastery, the factors of Imāmiyeh Shiite jurisprudents distance from central power and their reluctance to confirm and cooperate such an empire were really degraded and they accepted to shoulder the burden for carrying out some of the duties of infallible imams in the issue of ruling the society. They changed the definition of the term “Justice for Islamic Rulers” and directed the present condition of the time in favor of “Confirmation of Political Rulers’ Legitimacy” discourse. ظهور مغولان در رأس قدرت سیاسی، سبب تغییر نگرش جهان اسلام و بالتبع، فقهای امامیه در امر حکومت شد و آنان را واداشت تا به تغییر الگوی حکومت از «خلیفة اللهی» به «حاکم اسلامی» تن در دهند. پیش از حملة مغول، نفی مشروعیت هر حکومتی غیر از حکومت امام معصوم ع تقریباً نقطة مشترک میان دیدگاه اکثر فقهای شیعه بود و همکاری با آنان را در صورت ضرورت، تا حدی روا می شمردند که نافی این اصل نباشد که این نتیجة استیلای دیدگاه‌های کلامی بر فضای فکری فقهای شیعی بود، اما در دوران استیلای مغولان غیرمسلِم، عواملی که موجبات دور بودن امامیه از قدرت مرکزی و استنکاف آنان از تأیید و یا همکاری با آن می شد، عملاً کاهش یافت و فقهای امامیه با پذیرش برخی وظایف امام معصوم در امر ادارة جامعه و تحوّل در تعریف اصطلاح عدالت برای حاکمان اسلامی، عملاً شرایط پیش‌آمده را به نفع گفتمانِ «تأیید مشروعیت حاکمان سیاسی» پیش بردند. http://jostar-fiqh.maalem.ir/article_64483_278e95d3be67ca1e59b37bb6a289288a.pdf
