They have raised the some misconceptions such as islamic jurisprudence is based on the task and dependence of Western legal system on the right and conflict religious should and shouldn't with the right-oriented. Accordingly, in this research we are going to analyze right-oriented or Task-oriented of the islamic jurisprudence from the perspective of Sunni scholars and Imams' jurists, especially Ayatullah Javadi Amoli as creator of religious though. The method of this paper is to analyze-description. The research data was collected by using the library. Research findings it shows that with combining the horizons of religious scholars and expanding and integrating their votes can be obtained to important subscriptions. They agree on the idea that that language of jurisprudence is not only the language of duties but at times the jurisprudence is to appear language of duty, is spoken in order to ensure human rights. In fact jurisprudential should ways to preserve and protect the rights and jurisprudential shouldn't shows security injury rights. Thus, if a careful look at islamic jurisprudence, don't see unless the rights and interests and with this attitude we can say all tasks will return to rights. <strong>برخی معتقدند فقه اسلامی بیش از آنکه به حقوق انسانی توجه کند، انسان را به وظیفه­ مداری سوق داده، مکلف بار می‏آورد. آن­ها شبهاتی از قبیل مبتنی بودن فقه اسلامی بر تکلیف و ابتنای نظام فکری غرب بر حق و تعارض بایدها و نبایدهای دینی با حق­محوری را مطرح نموده ­اند. بر این اساس، در این پژوهش بر آن هستیم تا حق­ محوری یا تکلیف ­مداری فقه اسلامی را از دیدگاه علمای اهل تسنن و فقهای امامیه، به ­ویژه استاد جوادی آملی، به­ عنوان احیاگر فکر دینی مورد تحلیل و واکاوی قرار دهیم. نتایج تحقیق نشان می­ دهد که با درآمیختن افق دید عالمان دینی و بسط و تلفیق آرای آنان می­توان به اشتراکات مهمی دست یافت. آنان بر این نظر اتفاق دارند که زبان فقه نه تنها زبان تکلیف نیست، بلکه در مواقعی هم که فقه اسلامی به ظاهر زبان تکلیفی دارد، در راستای تأمین حقوق انسان سخن به ­میان آورده است. در واقع، بایدهای فقهی، راه­های حفظ و حمایت از حقوق و نبایدهای فقهی، نشان­ دهندۀ آسیب­های تأمین حقوق هستند؛ از این­رو، اگر با نگاهی دقیق به فقه اسلامی نگریسته شود، چیزی جز حق و مصلحت مشاهده نمی‌شود و با این نگرش می‌توان گفت همه وظایف به حقوق برمی‌گردند.</strong> http://jostar-fiqh.maalem.ir/article_68440_4a41c8c6b338a3f45dc3c40bc58eb762.pdf
