The term means the processing of any operation. <br />In fact, the algorithm is as an inferential device that is grounded in the knowledge of the principles, reasoned and theorized and given to the jurisprudent. The jurists in the jurisprudential discussions, of course, have had an algorithmic approach to the inference of the <em>Sharʿī</em> ruling, but they did not state it in a clear way, so the proposed algorithm of this research is to clarify the jurisprudence algorithm. Therefore, the proposed algorithm of this research is to clarify the Mental <em>(al-Irtikāzī</em>) algorithm of jurists. <br />The output of this algorithm is the <em>Sharʿī </em>verdict and its rank; that is, the inference algorithm must answer the question of whether the sentence has been legislated or not? And if so, has it reached actual level? And if it has reached actual level, has it reached its incontrovertible stage or not? Therefore, the proposed algorithm is based on the same hierarchy of verdicts. Therefore, in this paper, using the library resources and based on the descriptive-analytical method, the function of jurists is investigated to derive their inferential algorithm. <strong>مدتی است که در مجامع علمی، اصطلاح الگوریتم مطرح شده است. این اصطلاح، به معنای فرآیندسازی هر عملیاتی است. </strong><strong>از آن‌جا علم فقه، دارای عملیات استنباط است، می‌توان گفت استنباط فقهی، دارای الگوریتم است. </strong><br /><strong> این الگوریتم استنباط فقهی را باید از علم اصول طلب نمود؛ چرا که رسالت علم اصول، فراهم‌سازی قواعد کلی استنباط فقهی و فرآیند‌سازی آنها است. </strong><br /><strong> در واقع، الگوریتم به مثابه یک دستگاه استنباطی است که توسط علم اصول، مستدلّ و نظریه‌پردازی می‌شود و در اختیار فقیه قرار می‌گیرد.</strong><br /><strong> البته فقهاء در مباحث فقهی، نگاهی الگوریتمیک به استنباط حکم شرعی داشته‌اند؛ اما آن‌را به صورت شفاف بیان نکردند؛ از این‌رو الگوریتم پیشنهادی این جستار، شفاف‌سازی الگوریتم ارتکازی فقهاء محسوب می‌شود.</strong><br /><strong> خروجی این الگوریتم، حکم شرعی و تعیین مرتبه آن است؛ یعنی الگوریتم استنباط باید به این سوال پاسخ دهد که آیا حکم، جعل شده است یا خیر؟ و اگر جعل شده است، آیا به مرتبه فعلیت رسیده است یا خیر؟ و اگر به مرتبه فعلیت رسیده است، آیا به مرتبه تنجز هم رسیده است یا خیر؟ از این‌رو، الگوریتم پیشنهادی بر اساس همین مراتب حکم پی‌ریزی شده است. </strong><br /><strong> لذا در این نوشتار با استفاده از منابع کتابخانه ای و بر اساس روش توصیفی تحلیلی به بررسی عملکرد فقها پرداخته شده است تا بدین وسیله الگوریتم استنباطی ایشان استخراج شود.</strong> http://jostar-fiqh.maalem.ir/article_69136_c031dc1b31812345fd52ca03bfc14111.pdf
