Journal Article 2025 07 22 The work Makāsib al-Muḥarramah by Shaykh Murtaḍā al-Anṣārī is among the most foundational and influential texts in the Imāmī jurisprudence of transactions, and it occupies a distinguished position from the standpoint of ijtihādī methodology. The present study seeks to identify and analyse the structural features of Shaykh al-Anṣārī’s model of ijtihād in Makāsib al-Muḥarramah by examining three principal axes: the application of the principles of Uṣūl al-Fiqh in the process of legal inference (istinbāṭ), the systematic and rational analysis of transmitted evidence (adillah al-naqlīyyah), and the logical and sequential organization of jurisprudential discussions. Drawing upon authoritative commentaries on Makāsib by prominent jurists—including Muḥaqqiq al-ʿIrāqī, Muḥaqqiq al-Īrawānī, Sayyid al-Yazdī, Muḥaqqiq al-Khānsārī, Āyatullāh al-Khūʾī, and al-Shahīd al-Ṣadr—the study demonstrates that Shaykh al-Anṣārī, through integrating earlier and later methodological approaches and forging a deep connection between uṣūl and the jurisprudence of transactions, established an innovative and systematic model of ijtihād. Among his most significant methodological contributions are: The systematization of jurisprudential chapters; The precise delineation of points of dispute; The logical ordering of the stages of legal inference; The formulation of a general theory of contracts (al-ʿuqūd) as a comprehensive framework for analysing obligational relationships. The findings indicate that Shaykh al-Anṣārī, by presenting a rational, structured, and coherent model, transformed the jurisprudence of transactions from a predominantly textual and fragmented discourse into an analytical and systematic discipline. In doing so, he laid the groundwork for the development of a renewed ijtihādī methodology within the seminaries. In its concluding section, the study critically evaluates his views concerning ownership and rationally legitimate benefit, assesses the capacity of his methodological framework to address newly emerging economic and social issues, and clarifies its influence on redefining contemporary instances of Makāsib al-Muḥarramah. کتاب مکاسب محرّمه اثر شیخ مرتضی انصاری، یکی از بنیادی‌ترین و جریان‌سازترین منابع در فقه معاملات امامیه است که از منظر روش‌شناسی اجتهادی نیز جایگاهی ممتاز دارد. این نوشتار با هدف شناسایی و تحلیل ساختار اجتهادی شیخ در بخش مکاسب محرّمه، به بررسی سه محور اساسی می‌پردازد: بهره‌گیری از مبانی اصول فقه در فرایند استنباط، تحلیل روشمند و عقلانی ادله نقلی، و تنظیم منطقی و مرحله‌مند مباحث فقهی. پژوهش حاضر با رجوع به شروح معتبر مکاسب از فقهای برجسته‌ای همچون محقق عراقی، محقق ایروانی، سید یزدی، محقق خوانساری، آیت‌الله خویی و شهید صدر نشان می‌دهد که شیخ انصاری با تلفیق منهج قدیم و جدید و با پیوند عمیق میان اصول و فقه معاملات، الگوی تازه‌ای از اجتهاد نظام‌مند را بنیان نهاده است. از مهم‌ترین نوآوری‌های او می‌توان به نظام‌سازی ابواب فقهی، تحریر دقیق محل نزاع، چینش منطقی مراحل استنباط، و طرح نظریه العقود به‌عنوان قالبی عام برای تحلیل روابط اعتباری اشاره کرد. نتایج تحقیق نشان می‌دهد که شیخ انصاری با ارائه‌ی الگویی عقلانی، مرحله‌مند و منسجم در اجتهاد، فقه معاملات را از صورت نقلی و جزیره‌ای به ساختاری تحلیلی و نظام‌مند تبدیل کرده و زمینه‌ی گسترش روش اجتهادی جدید در حوزه‌های علمیه را فراهم ساخته است. در بخش پایانی، ضمن نقد دیدگاه او درباره‌ی مالیت و منفعت محلّله مقصوده، ظرفیت‌های روش وی در پاسخ‌گویی به مسائل مستحدثه اقتصادی و اجتماعی بررسی شده و تأثیر آن در بازتعریف مصادیق جدید مکاسب محرّمه تبیین می‌گردد.
