Since other articles in the law have rarely not pointed these referents, the judge has to act according to the principle 167 of the constitution and needs to refer to other authentic references and fatawa. Therefore, as determining the jurisprudential referents of stipulated religious punishments is an applied field, this research is initially to provide a definition of religious stipulated texts, and then to extract the punishments whose extents and types are somehow mentioned in order to study how these punishments are stipulated. Finally, according to the narrative and jurisprudential authenticity and publicity of each of the mentioned referents, merely the four fold crimes of adultery, abstinence in murder, observation of a murder, and sexual intercourse with a fasting lady are referents of religious stipulated punishments. <strong>بر اساس تبصره 2 ماده 115 قانون مجازات اسلامی مصوب سال 92، مجازات‌هایی که در قالب تعزیرات منصوص شرعی هستند مشمول برخورداری از امتیازات مهمی همچون مرور زمان کیفری، تعویق مجازات و تعلیق مجازات نخواهند بود. ازآنجاکه در هیچ‌یک از مواد قانونی دیگر، به این مصادیق پرداخته نشده است، قاضی موظف است مطابق اصل 167 قانون اساسی، به منابع و فتاوی معتبر مراجعه نماید؛ بنابراین، با توجه به کاربردی بودن تعیین فقهی مصادیق تعزیرات منصوص شرعی، در این تحقیق ابتدا با ارائه تعریف از منصوصات شرعی با استخراج مجازات‌هایی که به‌گونه‌ای نوع و میزان آن‌ها ذکر گردیده است به بررسی منصوص بودن آن‌ها پرداخته‌ایم. درنهایت با توجه به سند و شهرت روایی و شهرت فتوایی هر یک از این مصادیق، تنها جرائم چهارگانه یعنی خوابیدن دو نفر در زیر یک لحاف، امساک در قتل، نظارت در قتل و نزدیکی با زوجه صائمه را از مصادیق دارای مجازات تعزیر منصوص شرعی دانسته‌ایم.</strong> http://jostar-fiqh.maalem.ir/article_23026_571b93486fbdb1493e8b87597e678a21.pdf
