However, Ayatollah Hashemi Shahroudi’s view is in contradiction to the viewpoints of the majority of the jurisprudents and he believes that the word <em>observing</em> in texts refers to both naked and armed eyes. Delimiting the observation to the customary observation of the moon crescent by the time of text issuance is not valid. Likewise, based on the text of Sahiheye Mousa bin Ja’far given a sharp eyed person observes the moon, it is equal to observing the moon with magnifier and the jurisprudential criteria for both of them are alike. Thus, the present research is to substantiate the validity of new magnifiers in observing the moon crescent based on Ayatollah Hashemi Shahroudi’s viewpoint. The researcher has scrutinized the ten criticisms leveled against this viewpoint by great scholars such as Sayid Ali Sistani, Shaykh Ja’far Sobhani, Sayid Mahdi Khalkhali, and Shaykh Muhammad Taqi Shahidipour.  <br />[1] Received in: 22/8/2018                                                                   Accepted in:  28/2/2018     <br /> <br /> <br />[2] PhD of Islamic Law and Jurisprudence, Graduated from Edalat University and Researcher of Applied Jurisprudence at Civilizational Research Academy. <strong>مشهور فقیهان با استناد به روایات رؤیت برآن هستند که رؤیت تنها با چشم عادی اعتبار شرعی دارد و در اصطلاح با چشم مسلح کفایت نمی‌کند. اما آیت‌الله هاشمی شاهرودی با دیدگاه مشهور مخالفت کرده و بیان می‌دارد که رؤیت در نصوص نسبت به رؤیت با چشم عادی و نیز چشم مسلح اطلاق دارد. انصراف رؤیت به رؤیت متعارف زمان صدور نص، انصراف وجودی و مردود است. همچنین بر اساس صحیحه علی بن جعفر از امام موسی کاظم (ع) رؤیت شخص تیز بین (حاد البصر) که معتبر است با رؤیت به‌وسیله ابزار نزدیک‌کننده دارای وحدت مناط است.</strong><br /><strong> بدین ترتیب در این تحقیق به‌صورت تفصیلی و استدلالی اعتبار ابزار نوین نزدیک کننده در رؤیت هلال با محوریت دیدگاه آیت‌الله هاشمی شاهرودی اثبات می‌شود. اشکالات متعددی -که قریب به ده اشکال است- توسط برخی فقیهان مانند آیات و اساتیدی همچون سیدعلی سیستانی، شیخ جعفر سبحانی، سیدمهدی خلخالی و شیخ محمدتقی شهیدی‌پور به‌خصوصِ دیدگاه فوق شده است که تمامی آنها مورد بررسی و نقد قرار می‌گیرد.</strong> http://jostar-fiqh.maalem.ir/article_66757_4dd947422556a3c153f3ea3fd80cb373.pdf
