For instance, regarding the issue of security which has been focused on in different issues, the role and influence of permission has been noticed. The issue of correlation of permission and permissibility with non-security is not a new issue and has been discussed by some contemporary and many ancient jurisprudents. Not only have they supported the correlation of these two rules, but also it is implied that they have regarded such rules correlations as necessary and incontrovertible. However, in the contemporary period, the opposing theory has been more supported as it may seem to be incontrovertible. Having analyzed the drawbacks raised by critics of this rule, it is concluded that given such a correlation is raised generally in cases where permission is necessary, it is not true. But, in cases where there are obligatory permissibility toward the action as primary and it is not subjected to security, and in other hand, no one in this middle has faults or is blameworthy, such a correlation is proved and claimed. <strong>وجود یا عدم وجود اذن در عقود و ایقاعات، قراردادها و به‌طورکلی همه‌ رفتارها و اعمال حقوقی و به ­دنبال آن روابط عرفی و اجتماعی انسان‌ها، یکی از عناصر مهم و حیاتی بشر به ­شمار می‌رود؛ به‌عنوان نمونه، در مباحث مربوط به ضمان که در مسائل گوناگونی گسترده است، نقش و تأثیر اذن مورد توجه است.</strong><br /> <strong>مسئله ملازمه بین اذن و اباحه با عدم ضمان از مسائل نوپدید نیست و فقیهان بسیاری از گذشته تا عصر حاضر نه تنها طرفدار ملازمه بین این­ دو حکم می‎باشند، بلکه برخی ادعای ضروری و بدیهی بودن آن نیز از عبارات آن­ها فهمیده می­ شود، ولی در دوره معاصر نظریه مخالف بیشتر مورد توجه قرار گرفته؛ چنان­که حتی ممکن است بدیهی به­ نظر برسد. با بررسی ایراداتی که از سوی منتقدان این قاعده مطرح شده، می‎توان به این نتیجه رسید: اگر این ملازمه به­ صورت کلی در همه موارد وجود اذن مطرح شود، درست نیست، ولی در مواردی که اباحه تکلیفی نسبت به عمل به­ عنوان اولیه وجود دارد و مشروط به ضمان نشده است و از طرف دیگر شخص دارای قصور یا تقصیری نیست، می‎توان این ملازمه را ادعا و اثبات کرد.</strong> http://jostar-fiqh.maalem.ir/article_67426_a9588d9be0e68d5388c48ffb80d3fc0d.pdf
