Some contemporary and preceding jurisprudents contradict with this issue. Likewise, while the majority of jurisprudents believe in both its originality and consequences, some contemporary ones reject and consider it to be a redundant issue in principles of jurisprudence. There are different reasons supporting atheists' obligations to Islam's secondary principles most of which are narrative ones. However, it seems that intellectual reasons are prioritized to the narrative ones in this respect as considering the condition of knowledge and power in obligations, and the entailments of intellectuals' law-making are of importance. This research concludes that like Muslims, all atheists enjoy the conditions needed for obligations that is why they receive divine obligations and their atheism and ignorance do not eliminate these obligations, as the mentioned barriers deal with obedience which could be solved by acquiring knowledge and believing Islam. Therefore, the obligations they should take on are not <em>intolerable</em> and <em>in</em> <em>vain</em> and if the blameworthy atheists do not obey divine commands and prohibitions, it is because of their lack of authority and volition. This issue ensues different consequences in jurisprudence such as the validity of Muslim's trade with atheists and the permissibility of exporting goods to them which are unlawful and void in Islam. <strong>تحقیق پیش­ رو پیرامون مکلف بودن کفار به فروع دین اسلام و آثار آن در فقه است. برخی از فقهای قدیم و معاصر با این مسئله مخالفت نموده ­اند. برخی از معاصران نیز منکر آثار فقهی آن­اند و آن را جزء زواید علم اصول می­ شمارند، لکن مشهور فقها هم به اصل مسئله و هم به آثار فقهی آن معتقدند. بر مکلف بودن کفار به فروع، دلایل متعددی اقامه شده که بیشتر نقلی است، ولی به نظر می ­رسد دلیل عقلی و بنای عقلا در این مقام ترجیح دارد؛ آن هم با دو بیان: توجه به شرط علم و قدرت در تکلیف، و اقتضای محیط قانون­گذاری عقلا. نتیجه این تحقیق آن است که همه اقسام کفار همانند مسلمانان، شرایط تکلیف را دارا هستند؛ به همین جهت، موضوع جعل تکالیف الهی قرار می­ گیرند و کفر و جهل آن­ها مانع این جعل نیست؛ زیرا موانع مذکور، مربوط به مقام امتثال است که با کسب معرفت و ایمان آوردن، قابل برطرف شدن است. بنابراین تکلیف آن­ها «تکلیف ما لایطاق» و «لغو» نیست و عدم امتثال اوامر و نواهی الهی از ناحیة آنان در کفار مقصر، به دلیل سوء اختیار آنان است. این مسئله آثار متعددی در فقه دارد که از جمله آن­ها صحت معامله با کفار و جواز صادرات کالاهایی به آنان است که در شریعت اسلام باطل و حرام است.</strong> http://jostar-fiqh.maalem.ir/article_67588_7d715d4da0542f5298c4575d62b4baaf.pdf
