Therefore, as there is no agreement on whether those words that have been articulated in proportionate to the conventions of that time are inclusive of today’s problems or not, and taking into account the fact that their inclusiveness concerning contemporary examples has, in some cases, even been denied, the issue needs to be studied methodicallyaccording to Fiqh and Usul. This article, thus, set out to examine the challenges and obstacles of using generalities and absolutes for resolving new issues. Providing and analyzing fourteen examples of the existing or discussible obstacles in making use of legal generalities and absolutes is the achievement of this study. <br /><strong>Keywords:</strong> Generalities, Absolutes, New Issues, Absoluteness, Generality, Obstacles of inclusiveness. <strong>حجیت عمومات و مطلقات کتاب و سنت در استنباط مسائل فقهی ازجمله اصول مفروض در بین دانشوران فقه و اصول است. اما چنان‌که شاهدیم، استفاده از عمومات و مطلقات در مسائل مستحدثه دچار برخی چالش‌ها شده است؛ زیرا این الفاظ در صدر اسلام به کار رفته و امروزه موضوعاتی پدیدار شده‌اند که اساساً در آن روزگار وجود نداشته یا بسیار متفاوت‌اند. درنتیجه شمولِ آن الفاظ که در عرف آن روزگار صادر شده‌اند نسبت به مصادیق جدید امروزی که راویان و شنوندگان از وجود آن‌ها بی‌خبرند، مشکل و حتی گاهی انکار شده است، از این‌رو این مسئله، نیاز به بررسی روشمند براساس فقه و اصول است.</strong><br /> <strong>مقاله پیشِ رو به بررسی چالش‌ها و موانع بهره‌گیری از عمومات و مطلقات برای حلّ مسائل مستحدثه می‌پردازد. دستاورد این مقاله، ارائه و نقد چهارده نمونه از موانع موجود یا قابل‌طرح در استفاده از عمومات و مطلقات شرعی است.</strong> http://jostar-fiqh.maalem.ir/article_69388_045c67ef9c527dc46c1c40b016358752.pdf
