Comparison between Uṣūlī and Fiqhī Deduction Method of the Sheikh Ansari in Authority of Celebrity of Verdict

Abstract

The authority of the Celebrity of Verdict (al-Shuhra al-Fatwāʾiyya) is the topic of discussion between the scholars. Some have included examples from the works of the Shekh Ansari claiming that he has overtaken from his Uṣūlī method in regards to the Celebrity of Verdict. Then the reason for such an overtaking has been discussed. Some have proved his consideration in the closure proof (Dalīl al-Insidād) and considered his usage of the Celebrity of Verdict as using unconditional conjecture. Others have considered the reason as a psychological element that has made a great scholar such as the Sheikh Ansari to fall for a mistake as well. According to the findings of this article, which has used descriptive – analytical approach, aside from case studies of various examples and judgement of their verdicts, the two analyses mentioned here can be rejected; because the Sheikh denies the Celebrity of Verdict as an independent source. In another word there is no decisive reason for authority or devotional authenticity of the Celebrity of Verdict as an independent source. This does not have anything in contrary to the Celebrity of Verdict being used if the celebrity entails knowledge and certainty. It is because whenever the celebrity entails certainty, using it means using the certainty which itself is the common knowledge, rational authority and Shra’ī authority. Hence there is no disruption in Sheikh’s Uṣūlī view point and jurisprudential method.

إثبات حجیة الشهرة الفتوائیة هو موضع نقاش وخلاف بین العلماء، وقد ادعى بعض الباحثین بعد التتبع فی کلمات الشیخ الأنصاری وسرد عدد من النماذج أنه "رحمه الله" قد تخطى مسلکه الأصولی فی الشهرة الفتوائیة.
وأرجع هؤلاء سبب تخطى الشیخ هذا المسلک إلى أحد أمرین: فقد أثبت البعض أنّه "رحمه الله" انسدادی، واعتبروا أن تمسکه بالشهرة هو من باب التمسک بمطلق الظن.واعتبر البعض الآخر أن العنصر النفسی هو منشأ هذا التهافت، والذی أثّر على فقیه کبیر کالشیخ الأنصاری "رحمه الله".وفقًا لنتائج هذه المقالة، التی انتهجت الأسلوب الوصفی التحلیلی، بغض النظر عن ما یمکن قوله حول کل واحد من الشواهد والنماذج المذکورة وصحة أو عدم صحة فهمها، فإنّ التحلیلین المذکورین غیر صحیحین؛ لأنّ الشیخ الأنصاری"ره" ینکر حجیة الشهرة کدلیل مستقل؛ أی أنّه لا یوجد دلیل قطعی على حجیة الشهرة واعتبارها التعبدی کدلیل مستقل، وهذا لا ینافی إمکانیة التمسک بالشهرة اذا کانت مفیدة للعلم والاطمئنان؛ لأنّ التمسک بها فی هذه الحالة هو تمسک بالاطمئنان الذی هو علم عرفی وحجة شرعیة وعقلائیة، ونتیجة لذلک یثبت أنّه لا یوجد تناقض بین رأی الشیخ الأصولی ومسلکه الفقهی.
