A Feasibility Study into the Finding a Jurisprudential School of Thought from the Thought of Shaykh al-Mu’asis

Abstract

The study of the jurisprudential school of thought is a secondary study and sub-chapter of the philosophy of jurisprudence in which re-reading and analysis of jurisprudential movements with regard to elements such as: systematization, tendency, basics, methods and theories are discussed. Based on this, can the jurisprudential thought of Shaykh al-Mu’asis be considered as a school of thought? A contextual and capacity-based study of the jurisprudential thought of Āyatollāh Shaykh ‘Abd al-Karīm al-Hā’irī, to measure the degree of adaptation of these elements with a descriptive, explanatory, and historical method, shows that systematization means regulation, connection and a different arrangement of content and parts is not visible in his jurisprudence. However, there are trends, bases, methods and specific theories of jurisprudence that have their roots in the time and context of the formation of the jurisprudence of Muḥaqqiq al-Hā’irī in Najaf and Sāmarrā’, which has led to a distinctive cautiousness, rationality, and axial moderation. Thus, Āyatollāh Borūjerdī’s opinion on this jurisprudential thought, the authority of his famous students in the later periods, and the transfer of this legacy to the next generations, along with the phenomenon of the Islamic Revolution in Iran has been prepared the conditions for the formation, maturity and expansion of the late Qom School of Thought, which at least the jurisprudence of Shaykh al-Mu’asis is one of the most important reasons for its appearance.

أبحاث المدارس الفقهیة هی عبارة عن دراسات من الدرجة الثانیة وفرع فصلی فی علم فلسفة الفقه، وتتضمن هذه الدراسات مراجعة وتحلیل تیارات فقهیة وفق عدد من العناصر من قبیل: النظام، والاتجاه، والأسس، والمنهج، والنظریات، بناء على ذلک هل یمکن اعتبار الآراء الفقهیة والفکر الفقهی للشیخ المؤسس بمثابة مدرسة فقهیة متمایزة؟
إنّ دراسة تمهیدیة وقائمة على قدرات الفکر الفقهی لآیة الله الشیخ عبد الکریم الحائری بهدف قیاس مقدار توفر العناصر المشار إلیها آنفا وفق المنهج الوصفی التفسیری التاریخی تثبت عدم وجود نظام متمیز فی فکره بمعنى التنظیم والترابط والترتیب المتمایز والمختلف لمضمون وأجزاء هذا الفکر.
ولکن یوجد هناک منهج وأسس ونظریات فقهیة خاصة به، وهی تعود لجذور زمان وبیئة تشکل فقه المحقق الحائری فی النجف وسامراء، والتی أدت إلى اتصاف منهجه بالاحتیاط، والعقلانیة، ومحوریة الاعتدال، وبناء علیه فإن مجموع العوامل التالیة وهی اهتمام آیة الله البروجردی بهذه الآراء الفقهیة ومرجعیة تلامذته المبرزین فی المراحل التالیة وانتقال هذا التراث إلى الأجیال اللاحقة مع بروز الثورة الإسلامیة فی إیران شکلت الأرضیة لنضج وانتشار مدرسة فی قم المتأخرة؛ وکان فقه الشیخ المؤسس بالحد الأدنى من أهم عوامل ظهورها و وجودها.
