Distinguishing the Disposition of Justice in the Realm of Jurisprudence with the Basic Approach of Āyatollāh Ḥāʼirī

Abstract

The jurisprudence of the Ahl al-Bayt (peace be upon them) arose from the bosom of revelation, watered from the teachings of the Prophet Muḥammad and Imām ‘Alī (peace be upon them) and enriched by the tireless efforts of the students of Imām al-Ṣādiq (peace be upon him), including the efforts of Āyatollāh Ḥāʼirī. This study was written on the occasion of the 100th anniversary of the establishment of the Ḥawzah al-ʿIlmīyyah and honouring its founder. It is a study which uses the library method related to the topic of justice from the point of view of jurisprudence based on whether the description of malakah (disposition) and muruwwat is one of the elements of justice or not. Whether avoiding ṣaghāʼir (minors) involved in it or not? Thereby, after the conceptualization of justice from the aspect of words and terms, various bases of jurists have mentioned the definition of justice and their basis of taking a step on the straight path of shar’ has been emphasized. Other bases, including the basis of the interference of the malakah and muruwwat in justice, have been criticized under the title of innovation of the article. In conclusion, they have accepted the division of sin into major and minor, and have arranged jurisprudential effects on it, including the termination of justice by committing a minor sin.

نشأ فقه أهل‌البیت (ع) من حضن الوحی، وسقی من ینبوع المعارف النبویة والعلویة، وتغنى بالجهود الدؤوبة التی بذلها تلامیذ الإمام الصادق ع، ومنهم المحقق الحائری‌;.

تمت کتابة هذه المقالة بمناسبة الذکرى المئویة لتأسیس حوزة قم العلمیة ومؤسسها الشیخ عبدالکریم الحائری;، وهو بحث کتب وفق منهج المکتبات یتعلق بموضوع العدالة من وجهة نظر الفقه على أساس أنه هل یکون وصفّی الملکة والمرؤة من مقوّمات العدالة أم لا؟ و هل الإجتناب عن الصغائر دخیل فی العدالة أم لا؟

فی هذا الصدد، وبعد تحدید مفهوم العدالة لغة و فی الاصطلاح، نأتی بالمبانی المختلفة للفقهاء فی تعریف العدالة ومن ثّمّ التأکید على مبانی المحقق‌الحائری; فی تعریف العدالة وهو السَّیر فی طریق الشرع المستقیم، کما یتم نقد المبانی الأخرى بما فی ذلک تدخل الملکة والمرؤة فی العدالة تحت عنوان جدید وإبداع البحث، وأخیراً قبل الباحث بتقسیم الذنب والخطیئة إلى الکبیرة والصغیرة و رتّب علیها آثاراً فقهیة منها زوال العدالة بارتکاب الصغائر.
