Challenges of Contemporary Jurisprudence in Utilizing the Qurʼān to Inference Newly-Raised Queries and Solutions to Solve Them

Abstract

The scientific authority of the Holy Qurʼān in inferring jurisprudential rulings, especially in dealing with newly-raised queries and challenges of the contemporary world, is considered an important and challenging topic in the field of jurisprudence and Qurʼānic studies. This study aims to identify the challenges of contemporary jurisprudence in utilizing the Holy Qurʼān to infer newly-raised queries and to provide solutions to solve them. The main issue of this study is to identify the obstacles and limitations of using the Holy Qurʼān in responding to new jurisprudential queries and to provide solutions to overcome these challenges. Using a descriptive-analytical method and library resources, this study examines different perspectives on the scientific authority of the Holy Qurʼān in contemporary jurisprudence. In addition to precise conceptualization, the present study analyzes hermeneutical, linguistic, historical, and methodological challenges in the use of Qurʼānic verses to infer rulings on newly-raised queries. Also, various jurisprudential approaches in this field have been criticized and examined. The results of this study show that the major challenges in this field include the apparent conflict of some verses of the Holy Qurʼān with new scientific findings, linguistic and historical limitations in interpreting verses of the Holy Qurʼān, and differences in methods of referring rulings from the Qurʼān for newly-raised queries.
While analyzing the harms of existing approaches, the study presents a comprehensive model for utilizing the Qurʼān in inferring the rulings on newly-raised queries. The proposed solutions include reviewing the methods of interpreting and understanding verses of the Qurʼān, combining traditional and modern approaches, and providing a coherent framework for using the Qurʼān in responding to contemporary jurisprudential challenges. This study emphasizes the need to reform and improve educating and research methods in the field of jurisprudence and Qurʼānic interpretation and suggests new fields for future research in this field.

تحدیات وحلول الفقه المعاصر لمرجعیة القرآن فی استنباط المسائل المستحدثة

Abstract [العربیة]

تعد مرجعیة القرآن الکریم فی استنباط الأحکام الفقهیة، خصوصاً فی مواجهة المسائل المستحدثة وتحدیات العالم المعاصر، من أهم القضایا وأکثر الموضوعات إثارةً للتحدی فی مجال الفقه والدراسات القرآنیة. یهدف هذا البحث إلى التعرف على تحدیات الفقه المعاصر فی الاستفادة من القرآن الکریم فی سیاق استنباط المسائل المستحدثة وتقدیم حلول لها. وتتمثل المشکلة الرئیسیة لهذه الدراسة فی تحدید العوائق والقیود التی تحول دون الاستفادة من القرآن فی الإجابة على المسائل الفقهیة الجدیدة، وتقدیم حلول للتغلب على هذه التحدیات.


تتناول هذه الدراسة، بالمنهج الوصفی التحلیلی وباستخدام المصادر المکتبیة، دراسة وجهات النظر المختلفة فی مجال مرجعیة القرآن الکریم العلمیة فی الفقه المعاصر.


تتناول هذه الدراسة، بالإضافة إلى تحدید المفاهیم بدقة، تحلیل التحدیات الهرمینوطیقیة واللغویة والتاریخیة والمنهجیة فی استخدام الآیات القرآنیة لاستنباط أحکام المسائل المستحدثة.


کما تمّ نقد ومراجعة مختلف الاتجاهات الفقهیة فی هذا المجال. تُظهر نتائج هذا البحث أنّ التحدیات الرئیسیة فی هذا المجال تشمل: التعارض الظاهری لبعض الآیات مع النتائج العلمیة الحدیثة، والقیود اللغویة والتاریخیة فی تفسیر الآیات، والاختلاف فی مناهج استنباط الأحکام من القرآن للمسائل المستجدة.


تقدّم هذه الدراسة، بالإضافة إلى تحلیل نقاط الضعف فی المقاربات الموجودة، نموذجاً شاملاً للاستفادة من القرآن الکریم فی استنباط أحکام المسائل المستحدثة. تشمل الحلول المقترحة إعادة النظر فی مناهج تفسیر وفهم الآیات، والجمع بین المقاربات التقلیدیة والحدیثة، وتقدیم إطار متکامل لاستخدام القرآن فی الإجابة على التحدیات الفقهیة المعاصرة.


تؤکّد هذه الدراسة على ضرورة إصلاح وتحسین مناهج التعلیم والبحث فی مجال الفقه وتفسیر القرآن، وتقترح مجالات جدیدة للبحوث المستقبلیة فی هذا المجال.
